Agreement to Terms of Use

These Terms of Use apply to the video and survey feedback you provide when utilizing the Medallia LivingLens product in McLaren Racing Ltd marketing surveys. The survey and the Medallia LivingLens product is the property of McLaren Racing Ltd and subject to the McLaren Privacy Policy available at https://www.mclaren.com/group/privacy/. Additional terms, including disclaimers, not contained in these Terms of Use but pertinent to your use of the surveys are addressed in the McLaren Privacy Policy. BY USING THE SITE AND/OR PROVIDING FEEDBACK, YOU AGREE TO THIS PRIVACY POLICY; IF YOU DO NOT AGREE, DO NOT USE THE SITE OR PROVIDE FEEDBACK.

Content

By providing survey feedback, including video feedback (collectively “the Feedback”), you consent to McLaren’s use of the Feedback content for marketing purposes, including but not limited to future marketing events, creation and sharing of video showreels, and posting of social media content. If you provide the Feedback in your capacity as an employee or affiliated person of a company or other entity, you acknowledge that you have the authority to provide McLaren the Feedback in such capacity and that McLaren may use the content as set forth in these terms of use.

Changes to the Site/Updates/Terms

McLaren reserves the right to make changes to the surveys and requests for the Feedback at any time without notice. McLaren may make changes to the surveys and requests for the Feedback at any time without notice. McLaren makes no commitment to update the surveys and requests for the Feedback and may discontinue or curtail the surveys and requests for the Feedback and access thereof.

Any other use besides providing the Feedback, unless otherwise authorized in writing by McLaren, including the framing, linking to, reproduction (including photocopying or storage in an information storage/retrieval system), modification, distribution, transmission, republication, display, resale, data extraction, or data mining of the Feedback, or the preparation of derivative works based on the Feedback, is strictly prohibited. You will not tamper with, disable, reverse engineer, decompile or otherwise interfere with the proper functioning of the Site or the Feedback, or any content, proprietary notice, copyright management system or software associated with the Site or the Feedback, or misrepresent your identity in connection with any use thereof. All rights not expressly granted herein are hereby reserved.

Privacy

The Survey's Privacy Statement (available at mclaren.com/racing/inside-the-mtc/medallia-platform-privacy-statement/) and Medallia’s Privacy Policy (available at medallia.com/privacy-policy/) apply to processing of the personal information that may be contained in any of the Feedback you provide or that may be collected, processed and shared by McLaren in the context of your use of the Site and the survey. Additionally, by providing the Feedback, you acknowledge and understand that any Feedback content you send to the Site may be made publicly available. Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Modifications

McLaren reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site/Survey, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes; and (4) revoke or suspend any login or password. 

Violation of these Terms of Use

You agree that McLaren may, in its sole discretion and without prior notice, terminate your access to the surveys and/or the Site or block your future access to the surveys and/or the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site or provision of the Feedback.

You agree that McLaren may, in its sole discretion and without prior notice, terminate your access to the surveys and/or the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (including self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site including the Feedback, or (4) unexpected technical issues or problems.
